Dear Mr. Lodge:

This letter is in reference to the two petitions for rulemaking (PRMs), dated August 11, 2011, that you filed with the U.S. Nuclear Regulatory Commission (NRC) on behalf of Beyond Nuclear, et al. and, under separate cover, on behalf of Beyond Nuclear, et al. The NRC has determined that the petitions meet the NRCs requirements in Title 10 of the Code of Federal Regulations 2.802 for docketing of a PRM. The petitions were docketed on September 20, 2011, and have been assigned Docket Numbers PRM-51-26 and PRM-51-27, respectively.

The enclosed notice acknowledging receipt of your petitions will be published shortly in the Federal Register. As NRC staff reviews your petitions, it may be necessary to request additional information. Please reference the assigned docket number on any correspondence you may have concerning your petitions.

On September 9, 2011, the Commission issued a Memorandum and Order, Union Electric Company D/B/A/ Ameren Missouri et al. (Callaway Plant, Unit, et al.), CLI-11-05, __ NRC __

(Sept. 9, 2011) (slip op. at 41) which declined the petitioners request to suspend any of the licensing or rulemaking proceedings pending resolution of these rulemaking petitions. The NRC will consider the issues raised by these PRMs through the process the Commission has established for addressing the recommendations from the Fukushima Task Force Report and is not providing a separate opportunity for public comment on the PRMs at this time. The NRC will address the resolution of these petitions following the completion of the agencys actions to consider the Fukushima Task Force recommendations.
