NRC STAFFS RESPONSE TO QUESTION AT ORAL ARGUMENT As requested on October 14, 2011 during the oral argument for Petitioners NEPA Contention, NRC Staff has sought to answer whether the Applicant is required by the Commissions regulations to annually update its Environmental Report (ER). While 10 C.F.R. § 54.21(b) requires an annual amendment to the Applicants license renewal application, Staff has been unable to identify an explicit requirement that the Applicant update its ER. However, in practice, the NRC staff may issue Requests for Additional Information and applicants may update their Environmental Reports if relevant new and significant information becomes available.
