October 17, 2011 COMMONWEALTH OF MASSACHUSETTS MOTION TO REPLY TO NRC STAFF ANSWER TO MASSACHUSETTS REQUEST TO STAY COMMISSION DECISION ON PILGRIM WATCH APPEAL OR IN THE ALTERNATIVE TO STRIKE REFERENCE TO MASSACHUSETTS EXPERT Pursuant to 10 C.F.R. § 2.323(c), the Commonwealth of Massachusetts respectfully requests that it be allowed to submit this Reply to the NRC Staffs Answer to Commonwealth of Massachusetts Request to Stay Commission Decision [on the Pilgrim Watch appeal] or in the Alternative to Strike Reference to Massachusetts Expert (October 11, 2011)(Staff Opposition) because the Commonwealth could not have reasonably anticipated that the Staff would cite to law in its Opposition to a stay that is not referenced in the Commonwealths Answer and is not applicable to the relief that the Commonwealth requests. The Staff also impermissibly comments on the merits of the Commonwealths contention filings, which are currently pending for decision before the Pilgrim Atomic Safety and Licensing Board, and are not properly before the Commission for decision at this time.

Therefore the circumstances are compelling, and the Commission should allow the Commonwealths Reply.
