SUSQUEHANNA STEAM ELECTRIC STATION - NRC INVESTIGATION REPORT NO. 1-2010-055
Dear Mr. Rausch:
This letter refers to an investigation initiated by the NRC Office of Investigations (OI), Region I, on August 20, 2010, at PPL Susquehanna's (PPL) Susquehanna Steam Electric Station (SSES).
This investigation was initiated to determine if a Senior Reactor Operator (SRO) willfully failed to report a legal action taken by a law enforcement authority, as required. OI initiated the investigation after you identified the apparent misconduct by the SRO and reported the issue to the NRC.
Based on the evidence developed during the investigation, the NRC identified that the SRO willfully failed to report a July 10, 2010 citation and court summons issued by the Indiana State police until his second day back to work following the incident. The SRO had been on vacation when the incident occurred, and first came back to work on July 18, 2010, to work the night shift.
The SRO next worked the day shift on the 21st, and reported the incident to the Shift Manager at approximately 2:00 pm that day. A factual summary describing the results of the investigation is attached.
The NRC is evaluating this matter, and you will be advised by separate correspondence of the results of our deliberations. No response is required at this time. In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room and from the NRC=s Agency-wide Documents Access and Management System (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.

Enclosure Factual Summary, Office of Investigations (OI) Case No. 1-2010-055:
Susquehanna - Failure by a Senior Reactor Operator (SRO) to Report an Arrest This investigation was initiated on August 20, 2010, to determine if a licensed SRO willfully failed to notify his plant supervisor that he was detained and issued a summons to appear in court for indecent exposure while traveling out of state on vacation. The SRO did not make the report until his second day back to work, following the incident. Testimony and documentation obtained by OI confirmed that the SRO had been detained by the Indiana State Police on July 10, 2010. He was asked to get out of his vehicle and given a citation for public indecency/indecent exposure that said COURT APPEARANCE-you will be contacted by the court. The police officer explained that he would be informed of a court date within five to eight weeks.
The SRO reported back to work during the night shift on July 18, 2010. He did not report the incident until midway through his second day back to work on July 21, 2010, when he reported the incident to his Shift Manager. The Shift Manager called site access staff, the SRO was immediately interviewed, and his site access was immediately suspended after he was escorted out of the protected area.
OI collected documentary evidence from PPL, including a written statement by the SRO that he understood Susquehannas policy for Notification of Legal Action. This policy required that any formal action taken by a law enforcement agency, including being held, detained, taken into custody, etc., must be reported to the supervisor and site access services no later than on the first day back to work. OI also determined that the SRO had been employed at Susquehanna for over 27 years and had been an SRO since 2003 (at the time of the OI report, he was the unit supervisor in the control room). The SRO also testified that he knew that he was required to report non-traffic citations to a supervisor by the first day back to work after the citation. The SRO testified that he was unsure whether the citation was reportable or not and he wanted to ask a supervisor about it. But he failed to ask a supervisor or report the citation to anyone at SSES until midway through his second day back to work on July 21, 2010.
