x DECLARATION OF JANICE A. DEAN Pursuant to 28 U.S.C. § 1746, Janice A. Dean hereby declares as follows:

1. I am an Assistant Attorney General for the State of New York, counsel for petitioner-intervenor State of New York in this proceeding.

- On August 16, 2011, 1.consulted with the Applicant and NRC Staff concerning the Stales' intention to file a motion seeking leave to File a Reply to Staffs Answer to Entergy's Petition for Review of LBP- I1-17.

3. Counsel for NRC Staff sent me an email indicating that Staff opposed the States' request. Staff counsel's email asked me to include a statement in my certification. I indicated to Staff counsel I would do so.
4. In the certification I included with the States' motion. I accurately indicated that Staffopposed the States' motion. However, I inadvertently failed to include the statement Staff had asked. and I had agreed, to include.

My omission was not intentional and I regret any inconvenience this inadvertent omission has caused. I was not made aware of my mistake until I read NRC Staffs Answer to The State of New York and the State of Connecticut's Combined Motion for Leave to File A Brief Reply to NRC Staff s Answer to Applicant's Petition for Review of LBP-1 1-17.

6. 1 attach a conrected Certification including the Staff s requested language which I respectfully ask be considered when the Commission considers the States' motion.
7. 1 declare under penalty of prILury that the foregoing is true and correct.

Corrected Certification States' Motion for Leave to File a Reply to Staffs Answer to Entergy's Petition for Review of LBP- I 1-17 originally Filed August 16. 2011 Consultation with Parties Pursuant to 10 C.F.R. § 2.323 I certify that I have made a sincere effort to contact the other parties in this proceeding, to explain to them the factual and legal issues raised in this motion, and to resolve those issues, and I certify that my efforts have been unsuccessful. Entergy opposes this request on the ground that the reply sought is not authorized by the NRC's Rules of Practice in 10 C.F.R. Part 2. The Staff oppnses the States request "on the grounds that the reply is not authorized by the rules (which also bar the Staff froom filing a reply to the State's Answer), and the Staffs Answer does not differ substantially from the position expressed in its cross-motion for summary disposition or its petition for review of the Board's previous decision."
