Message Regarding Water Quality Permit This is the text which was contained in the IPEC Morning Report that was just emailed to the site.
Entergy notified NRC June 21 that the agency must determine whether the state of New York has waived its right to issue a water quality certificate for Indian Point 2 and 3, which NRC requires in its license renewal reviews. New York's Department of Environmental Conservation failed to issue a final decision on the utility's April 2009 application for the permit within one year, as required by provisions of the federal Clean Water Act, Entergy said in a June 21 statement. The utility applied in 2007 to NRC for 20-year license renewals for Indian Point -2 and -3, whose licenses expire in 2013 and 2015, respectively. Federal law requires NRC to notify the US Environmental Protection Agency that a water permit waiver has occurred, Entergy said. Entergy contends the state has waived it right to issue this permit, "so the NRC can move forward with the license renewal process," Entergy spokesman Jim Steets said June 21.
