VOGTLE ELECTRIC GENERATING PLANT: FAILURE TO REPORT AN ARREST BY A CONTRACT EMPLOYEE (OFFICE OF INVESTIGATIONS CASE NUMBER 2-2011-010)

Dear Mr. Tynan:

This refers to an investigation completed by the Nuclear Regulatory Commission=s (NRC) Office of Investigations (OI) on April 27, 2011, regarding the actions of a contract individual employed by Williams Plant Services (WPS) at Southern Nuclear Operating Companys (SNOC) Vogtle Electric Generating Plant (Vogtle). The purpose of the OI investigation was to determine whether the contract individual willfully failed to report an arrest. The enclosure to this letter provides a synopsis of the investigation.

Based on a review of the circumstances and the OI investigation, the NRC has concluded that SNCs actions in this regard did not represent a violation of regulatory requirements. In addition, SNCs actions after becoming aware of the individuals failure to report an arrest were appropriate. Accordingly, we plan no further action with regard to this matter. Based upon the evidence developed during the investigation, OI:RII determined that a former laborer, Williams Plant Services (WPS), Vogtle, willfully failed to report an arrest.
