Dear Mr. Pacilio:

The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.

1-2010-046) on July 15, 2010, to determine whether a Security Officer (SO) at the Peach Bottom Atomic Power Station willfully failed to report the use of a potential disqualifying prescription medication and a medical condition. Based upon the documentary and testimonial evidence developed by OI, the NRC was unable to substantiate the assertion.

OI noted several pertinent events that were considered to be non-credible or inconclusive regarding this matter. Specifically, there was insufficient evidence to conclude that the SO had actually consumed any of the prescription medication, the SOs knowledge of the pertinent procedures was insufficient, there were no conduct or Behavioral Observation Program (BOP) issues with the SO, and there was a lack of evidence to corroborate or disprove the SOs claim that the matter had been discussed with his/her supervisor.
