August 18, 2011 EN 11-027 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: First Energy Nuclear Operating Company EA-11-148 Perry Nuclear Power Plant Docket No. 50-440

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation will be issued on or about August 25, 2011, to First Energy Nuclear Operating Company (licensee) as a result of a special inspection at the Perry Nuclear Power Plant. The escalated enforcement action consists of a White finding, an issue with low to moderate safety significance, with three associated violations involving work activity during the retraction of a stuck source range monitor (SRM) from the reactor vessel.

The violations associated with this White finding are:

1. Contrary to 10 CFR 20.1501, the licensee failed to perform an evaluation of the potential radiological hazards associated with the work activity prior to authorizing removal of an irradiated incore SRM.
2. Contrary to Technical Specification 5.7.1.b, the licensee failed to perform a complete radiological characterization of the SRM (a radiological source of unknown magnitude),

which was being pulled toward the work area and toward the workers escape path.

Consequently, the licensee did not inform the workers of the potential dose rate levels associated with their entry into the high radiation area.

3. Contrary to Technical Specification 5.4.1, the licensee failed to establish a procedure that addressed the control of highly radioactive materials removed from the reactor vessel through the under-vessel area, as well as, failed to implement the procedure to ensure that their ALARA plan associated with the work activity contained steps to ensure that the ambient radiation field in the work areas were being controlled and that the worker actions were in accordance with ALARA considerations.

Corrective actions taken and/or planned to be taken to address this issue include, but are not limited to, revisions to related procedures, incorporation of this event in their training program and implementation of an interim effectiveness review.

It should be noted that the licensee has not been specifically informed of the enforcement action.
