Dear Administrative Judges:

The NRC staff ("Staff") wishes to inform you of two developments that may be relevant to admitted contentions in this proceeding.

First, on July 21,2011, the Staff issued Regulatory Issue Summary ("RIS") 2011-07. pertaining to aging management programs for reactor pressure vessel ("RPV') internals. The RIS addresses the acceptability of aging management programs for RPV internals that rely upon MRP-227, and is potentially relevant to Contention NYS-25, as amended, in this proceeding. A copy of RIS 2011-07 (ML111990086) is enclosed herewith.

Second, on July 26, 2011, the Staff issued a Supplement to its revised Biological Assessment

("Revised BA") of December 10,2010, to address certain information it received concerning potential impacts to shortnose sturgeon arising from thermal discharges at Indian Point Units 2 and 3. The Staff expects to discuss this Supplement with the National Marine Fisheries Service

("NMFS") during ongoing consultations between NMFS, the Staff and Entergy Nuclear Operations, Inc. under the Endangered Species Act. The Supplement is potentially relevant to Contention Riverkeeper EC-8 in this proceeding. A copy of the Staff's letter to NMFS of July 26, 2011 (ML11203A100) is enclosed herewith.
