Dear Mr. Heacock:
By letter to the U.S. Nuclear Regulatory Commission (NRC, the Commission) dated July 1S, 2011 (Agencywide Documents Access and Management System (ADAMS) Accession No.
Ml111990111), the Dominion Energy Kewaunee, Inc.: (1) committed to submit a license amendment request (LAR) by September 29, 2011, to transition to National Fire Protection Association Standard NFPA 80S in accordance with Title 10 of the Code of Federal Regulations, Section S0.48(c), and (2) requested that enforcement discretion for fire protection issues be extended to correspond with the LAR submittal date.
The NRC staff has reviewed your letter and finds it consistent with Commission direction as provided in SRM-SECY-11-0061, dated June 10,2011 (ADAMS Ml111610616). Therefore, your request to extend enforcement discretion is granted in accordance with the Interim Enforcement Policy concerning Enforcement Discretion for Certain Fire Protection Issues as published in the Federal Register on July 12, 2011 (76 FR 40777).
If you are unable to meet the above lAR submittal date, you are requested to contact the NRC staff at least 90 days in advance. Please contact Karl Feintuch on 301-41S-3079 if you have any questions.
