CONCERN REGARDING EMERGENCY RESPONSE ORGANIZATION STAFFING ANALYSES
Dear Mr. Walters:
The U.S. Nuclear Regulatory Commission (NRC) has received your letter dated July 6, 2011, requesting the staff to address several issues prior to the implementation of the Final Rule:
Enhancements to Emergency Preparedness Regulations (10 CFR Part 50 and 10 CFR Part 52). For example, you raised a concern with the proposed requirement to include the shift staffing analysis in the emergency plan. The NRC staff is preparing a detailed assessment of the current draft guidance for on-shift staffing in an effort to ensure that a clear and consistent regulatory framework is established prior to the implementation of the final emergency preparedness (EP) rule.
Each of your concerns will be addressed in a follow-up letter that will be issued within the next several weeks. Given the expected near-term promulgation of the final EP rule, it is imperative that any clarification needed in the guidance on issues such as these is made to ensure that licensees are able to implement rule requirements within the prescribed timeframes.
