RE: NFPA 805 Commitment Letter from Kewaunee Craig Sly, Dominion Licensing for Kewaunee called today to convey their plans regarding the timing of a commitment letter. The key question for which Kewaunee seeks a response (via return message or a conference call) is:

To meet NRC expectations Does Dominion-Kewaunee have to accelerate its schedule for issuing a commitment letter?

If Dominion does not have to accelerate its decision making, it is currently proceeding as follows:

On or before 7/08/2011 = decide to accelerate internally Dominions decision and commitment letter, if NRC expectation is to do so. Otherwise,

On or before 7/15/2011 = reach internal decision whether to issue NFPA-805 plan by 7/29/11, or 8/31/11, or 9/30/11. To accomplish this decision, Dominion needs to assess progress and estimate a completion date. 7/15/2011 is the date by when Dominion currently believes it can estimate such a completion date

On or before 7/18/2011 = issue the subject commitment letter, based on the decision made by Dominion..

This information (above) expands on the attached document (7/1/2011, 3:06 PM, Sly to Feintuch). Some of you are out of the office on leave at this time. I would like to respond to the 7/8/2011, milestone within this week. As a practical matter, accelerating the schedule to meet our expectation moves it forward by approximately one calendar week faster than their currently planning would.

2 Craig Sly (Dominion corporate for Kewaunee) called me in response to my emailed enquiry. Your speculation (they may be under the impression that they do not need to submit a commitment letter) was correct. Sly had based his inaction on an interpretation within the SECY paper in combination with an earlier communication pertaining specifically to Kewaunee.

I dont want to portray (or misrepresent) how he came to not provide that commitment letter, so I asked him to explain in an email what happened. Something in our communications is still confusing to him. After I forward his communication to you as reply all, we will have the agenda for a conference call next week, if that is indicated by his response.

NFPA 805 Commitment Letters from Kewaunee and Waterford

Karl/Kaly - With the exception of Waterford and Kewaunee, we have received NFPA 805 commitment letters from all the non-pilot plants. Can you both ask your licensee when we should expect to see their commitment letter?

Kaly - We are expecting Waterfords submittal in September. We also understand we may need to have a phone call to discuss alternate PRA methods.

Karl - There may be some confusion regarding whether Kewaunee. We expect their submittal by July 29 and they may be under the impression that they do not need to submit a commitment letter. However, since they did not meet the June 29 date, we were expecting a letter from them.

Also, FYI, I will be out of the office next week. Thus, please respond to Harry, Paul, and Alex.
