EDWIN I. HATCH NUCLEAR PLANT RESPONSE TO CDBI-BACKFIT APPEAL
Dear Mr. Madison:
Thank you for your response dated June 17, 2011, to our inspection report 05000321 and 05000366/2011009 dated May 25, 2011, regarding the NRCs imposition of a backfit involving degraded voltage protection system setpoints and analytical limits for the 4160 V buses at the Hatch Nuclear Plant (HNP). This acknowledges receipt of your letter in which you appealed the NRC decision to use the compliance exception provision allowed by 10 CFR 50.109(a)(4)(i). You stated that the NRC should have pursued a cost-justified substantial safety enhancement backfit and the required analysis in accordance with 10 CFR 50.109(a)(3) with regard to the degraded voltage protection system setpoints at HNP. We will review the information, including the points of disagreement you provided, when assessing the appeal.
In accordance with 10 CFR 2.390 of the NRCs "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRCs document system (ADAMS).
