ACKNOWLEDGEMENT LETTER TO CONFIRM RECEIPT OF JUNE 7, 2011, NEI LETTER ON DESIGN FEATURES
Dear Ms. Schlueter:
This letter is in response to your letter, dated June 7, 2011, regarding the use of design features in the integrated safety analysis. The U.S. Nuclear Regulatory Commission (NRC) appreciates the Nuclear Energy Institutes (NEI) perspective on this issue and is carefully reviewing the letter and enclosures, as well as the proposed path forward. In addition, the staff is reviewing your letter, dated June 10, 2010, on this subject.
We understand that this is an important regulatory matter; therefore, we would like to discuss your suggested edits to NUREG-1520, Revision 01, in a public meeting to ensure clear communication has occurred. We would like to offer you the opportunity to explain in more detail the suggested approach discussed in your letter. To best understand the proposed approach, it would be very helpful if the industry provides representative examples of design features and how they are used to comply with the regulatory requirements of Title 10 of the Code of Federal Regulations Part 70 (10 CFR). Additionally, it would be helpful for industry representatives to describe the provisions that the industry proposes to have in place to ensure a quality configuration management system is maintained for design features.
We will contact you in the next few days to establish a date for our next public meeting and to develop the agenda for that meeting.
In accordance with 10 CFR 2.390(d) of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records System component of NRCs document system (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). The change request summary and other enclosures to Letter 10-004 will be withheld from the public in accordance with 10 CFR 2.390(b).
