June 7, 2011 EN 11-014 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Nebraska Public Power District EA-11-024 Cooper Nuclear Station Docket No. 50-298

Subject:

ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission of an escalated enforcement action that will be issued on or about June 10, 2011, to Nebraska Public Power District (Licensee) as a result of inspections at Cooper Nuclear Station. The enforcement action consists of a White finding associated with a violation of 10 CFR 50, Appendix B, Criterion XVI, Corrective Action and Criterion V, Instructions, Procedures, and Drawings.

The White finding, an issue with low to moderate safety significance, along with a violation, involved the licensees failure to establish measures to assure a condition adverse to quality was corrected and ensure the activities affecting quality were prescribed by documented procedures appropriate to the circumstances. A White Notice of Violation (NOV) issued June 13, 2008, (EA-07-204,05000298/2008008-001) identified a condition adverse to quality in that Emergency Procedures 5.4 POST-FIRE and 5.4 FIRE-SD would not work as written. While correcting that violation, contrary to 10 CFR 50 Criterion XVI, the licensee failed to perform sufficient evaluation of the circuits to identify and correct a problem with three motor-operated valves needed to establish core cooling, RHR-MOV-25A, RHR-MOV-25B and RHR-MOV-53A. Failure to correct the condition adverse to quality resulted in inadequate procedures, Emergency Procedures 5.4 POST-FIRE and 5.4 FIRE-SD, in that they contained steps that were inappropriate to the circumstances because they would not work as written to reposition the three motor-operated valves, contrary to 10 CFR 50 Criterion V.

It should be noted that the licensee has not been specifically informed of the enforcement action.
