UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENSING BOARD Before Administrative Judges:

Lawrence G. McDade, Chairman Dr. Kaye D. Lathrop Dr. Richard E. Wardwell In the Matter of ENTERGY NUCLEAR OPERATIONS, INC.

(Indian Point Nuclear Generating Units 2 and 3)

Docket Nos. 50-247-LR and 50-286-LR ASLBP No. 07-858-03-LR-BD01 June 2, 2011 NOTICE (Setting Prehearing Teleconference)

The Board is in receipt of a letter from the NRC Staff, indicating Staffs intention to file a Supplement to its Safety Evaluation Report (SER) no earlier than July 2011, and that the Staff anticipated that the SER Supplement would address issues raised in admitted contentions.1 Because of this development, the Board will hold a teleconference at 9:30 AM EDT on Monday, June 6, 2011, to address the impact that the publication of this SER Supplement may have on the schedule in this proceeding. Specifically, during this teleconference the parties should be prepared to discuss the impact that this development might have on additional mandatory disclosures, the potential for new or amended contentions, and the dates on which direct testimony should be submitted.

No later than 12:00 PM EDT on Friday, June 3, 2011, a representative from each participant in this proceeding shall contact the Boards law clerk, Joshua Kirstein, Esq., at josh.kirstein@nrc.gov to obtain the telephone number and passcode to access the teleconference. Each participant in the teleconference shall specify to Mr. Kirstein the number of telephone lines requested for the 1 Letter from Sherwin S. Turk, Counsel for NRC Staff, to Atomic Safety and Licensing Board at 1 (May 26, 2011).

teleconference and the name of that participants counsel or representative who will be speaking on its behalf.

Because established deadlines in this proceeding are rapidly approaching, the Board determined that this teleconference needed to be set quickly, with only very short notice to the parties. Accordingly, given that this teleconference will address scheduling, as opposed to substantive issues, and that it would not be possible within the time available to provide meaningful notice to the public, we will not provide telephone lines to allow public access to this teleconference. However, a transcript will be prepared and promptly posted on the NRCs Electronic Hearing Docket.

FOR THE ATOMIC SAFETY AND LICENSING BOARD2 Lawrence G. McDade, Chairman ADMINISTRATIVE JUDGE Rockville, Maryland June 2, 2011 2 Copies of this Order were sent this date by Internet e-mail to: (1) Counsel for the NRC Staff; (2)
