Dear Administrative Judges McDade,

Wardwell, and Lathrop:

In response to. the May 26, 2011 letter from NRC Staff to the Atomic Safety and Licensing Board concerning Requests for Information and the supplemental Safety Evaluation Report, the State of New York supports NRC Staff s suggestion that the ASLB convene a conference to discuss potential impacts on the schedule for filing testimony. In addition, the State respectfully suggests that the conference review the deadline for pre-filed opening testimony concerning NEPA-related contentions.

In response to the inquiry from the ASLB's law clerk, Mr. Joshua Kirstein, there is no time on June 1, 2, and 3, 2011 that no representatives for the State would be available for such a conference. Stated differently, I am available on those days for such a conference. The State notes that Ms. Joan Matthews of the Department of Environmental Conservation is slated to attend a "government-to-government" meeting between NRC Staff and State and local officials on June 1, 2011 between 1:00 and 4:00PM.

In the coming days, I will endeavor to discuss the above scheduling issues with counsel for NRC Staff, Entergy, and the other intervenors.
