KIRSTEN F. GiLLIBRAND COMMIT May 24, 2011 Gregory B Jaczko Chairman U.S. Nuclear Rcgulatory Commrrssion Washington, D.C. 20555-0001

Dear Chairman Jaczko,

I am writing regarding the Nuclear Regulatory Commission's (NRC) recently completed inspection of Indian Point Nuclear Generating Unit 2 and Unit 3, which was performed as part of a national review of America's nuclear facilities in response to the tragedy at the lFukushima l)aiichi Nuclear Station. I have read the inspection report that was released last week, and feel that a top to bottom review of all past agreements and exemptions granted to the licensee are vital to the safe operation of these unuits.

There are more than 17 million people who live within 50 miles of Indian Point, and the safety of this facility' is of paramount importance. Your report highlighted several problems at tile site; specifically the delinquency of testing of hydrogen containment units; testing procedures based on past agreements between the NRC and the licensee that is specific to Unit 9- The failure of tile licensee to perform these important safety tests is but one example of the need for regulators to review all past agreements and exemptions granted to the licensee to determine if those agreements are being upheld and if past exemptions should be reassessed.

I urge you give this request the highest importance, and encourage this assessment to be completed as part of the ongoing review of all 104 operating units in the United States. I thank you again for your visit to the plant this month and your continued diligence in ensuring the safety of the nation's nuclear fleet. If you or your staff should have any questions, please feel free to contact Ben Rosenbaum in my Washington, DC Office.

Sincerely, Kirsten E. Gillibrand United States Senator
