Dear Administrative Judges:
The State submits this letter to bring two supplemental citations to the attention of the Board and the parties in connection with the State of New York's Motion to Compel NRC Staff to Produce Documents Relied upon in Staff's Final Supplemental Environmental Impact Statement (April 22, 2011).
Page 10 of the State's Motion argues that the obligations of NRC Staff under 10 C.F.R. § 2.336(b) are greater than the obligations imposed on the parties pursuant to 10 C.F.R. § 2.336(a).
In further support of that proposition, the State adds the following citation:
South Texas Project Nuclear Operating Company (South Texas Project, Units 3 and 4), CLI-10-24 (September 29, 2010), slip op. at n. 70.
Pages 16-17 of the State's Motion argue that all the underlying documents which support the opinions of a contractor upon whom reliance is placed in the FSEIS are required to be produced. In further support of that-proposition, the State adds the following citation:
