RE: Letter from NRC requesting Sect 7 Conference at Salem

Julie, Your proposed 60-day extension to July 12 is okay on the NRCs side.

I do want give you a heads up that NRC will be making a licensing decision on whether or not to issue renewed licenses to Salem and Hope Creek on June 30.

In the past, when the NEPA review is completed (final EIS published) before the section 7 consultation is completed, the NRC treats the section 7 consultation as separate from the NEPA review once the final EIS is published. Though the section 7 consultation was triggered by the NEPA review, because the section 7 consultation falls under the ESA, which does not specify timelines for completing the consultation before an action can be take, the licensing decision date of June 30 should not impact the section 7 consultation timeline.

Sorry for that complicated explanation! I just wanted to let you know how NRC generally justifies the licensing decision date occurring before the conclusion of section 7 consultation. If you have questions, let me know. I would be happy to answer via phone or email.

Hi Julie, I believe you touched based with Dennis Logan earlier this week regarding Oyster Creek, but had also asked about Salem and when/if the NRC was going to request a conference to be part of the section 7 consultation. I wanted to let you know that NRC just put a letter in the mail yesterday from my supervisor (Andy Imboden) addressed to Mary Colligan requesting a formal section 7 conference for the Atlantic sturgeon at Salem. Since you will be preparing the biological opinion, I attached an electronic copy of the letter to this email so that you have an advance copy. Please let me or Dennis know if you have any questions. Thanks, Briana BrianaA.Balsam Biologist
