Dear Mr. Rielly,

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your letter dated March 17, 2011, in which you appealed the agency's March 8, 2011, decision related to your February 14, 2011, Freedom of Information Act/Privacy Act (FOIA/PA) request (FOIA/PA-2011-0087). You appealed the adequacy of the search for records related to the decommissioning and site restoration of the Zion Solutions LLC, Zion Nuclear Power Station.

Acting on your appeal, we searched again for records subject to the request but did not locate any additional records. Therefore, your appeal is denied.

In a telephone conference with NRC staff on March 28, 2011, we informed you that there is no regulatory requirement for licensees to submit detailed information accounting for the expenditure of decommissioning funds, beyond the annual report of funding status required by Title 10 of the Code of FederalRegulations 50.75(f). You expressed an interest in letters of credit related to the subject licensee's recent license transfer. Although the scope of your original request did not include letters of credit, the staff is providing one additional document in the interest of completeness. The record is enclosed.

This is a final agency decision. As set forth in the FOIA (5 U.S.C. 552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia.
