As previously indicated in public announcements and meetings, Progress Energy Carolina, Inc. is developing a Combined Operating License Application(COLA) for submittal to the U.S. Nuclear Regulatory Commission (NRC), in accordance with the requirements of 10 CFR 52 for the Harris Nuclear Plant site near Raleigh, North Carolina. The COLA outlines Progress Energy's plans for construction and operation of two proposed new power generating units at the existing Harris Nuclear Plant site.
A key part of the COLA is the development of emergency plans which provide information sufficient to demonstrate compliance with pertinent regulatory requirements. The COLA will take credit for the federal, state, and local plans already in place at the Harris Nuclear Plant in support of Unit 1. In addition and with cooperation of the affected State and local agencies, Progress Energy has developed as part of its COLA the Shearon Harris Nuclear Power Plant Units 1, 2, and 3 Emergency Plan. The COLA Emergency Plan addresses onsitejoffsite activities to support a 3-unit site and includes a description of the current emergency classification system for Unit 1 and also a description of the emergency classification system for the new units required by NRC regulations.
Progress Energy has worked with the nuclear industry to develop a set of initiating conditions and emergency action levels consistent with the emergency classification system and appropriate to the proposed new nuclear plant design.
In addition to the COLA Emergency Plan, the Harris Nuclear Plant evacuation time estimate has been updated with input from various State and local government agencies in North Carolina. The evacuation time estimate report is included in the COLA.
Emergency planning provisions of 10 CFR 52 and the COLA process require that Progress Energy "make good faith efforts to obtain certifications from the local and State governmental agencies with emergency planning responsibiliti es" that the agency will participate in emergency planning and support emergency response to the proposed new units, if constructed. At this time, we are seeking certification from the Harnett County Emergency Management that:

the proposed emergency plans are practicable; HarnettCounty Emergency Management is committed to participating in anyfurther development of the plans, including any required field demonstrations; and Harnett County Emergency Management is committed to executing their responsibilities under the plans in the event of an emergency.
The actual emergency planning arrangements would be finalized in a revised letter of agreement at a later stage in the licensing process.
HarnettCounty Emergency Management's participation in these emergency planning efforts is greatlyappreciated. Your signature below also indicates that you concur with the emergency classification system (including the initiating conditions and emergency action levels) and evacuation time estimates proposed in the Harris Nuclear Plant COLA Emergency Plan.

HarnettCounty Emergency Management has reviewed the Emergency Plan supporting the Combined Operating License Application for two new proposed generating units at the Harris Nuclear Plant and certifies the following:
the proposed Emergency Plan is a thorough, practical, and useful tool for use in managing real life events; HarnettCounty Emergency Management has participated fully in the past and will continue to participate in the continuing planning efforts and scheduled field demonstrations for this Emergency Plan; HarnettCounty Emergency Management is committed to leading the effort to ensure that the health and safety of the public is maintained as the highest priority in the implementation and continued improvement of the emergency preparedness and response plans for the Harris Nuclear Power Plant site; and HarnettCounty Emergency Management is committed to executing their responsibilities under the plans in the event of an emergency.
Furthermore, HarnettCounty Emergency Management concurs with the proposed emergency classification system, initiating conditions, and emergency action levels described in the Emergency Plan and evacuation time estimate update (HNP Development of Evacuation Time Estimates, August 24, 2007).
It is my understanding that the specific nature of arrangements in support of emergency preparedness for operation of the proposed new nuclear units will be clearly established in a properly executed and binding letter of agreement that will be included in the Emergency Plan, if and when Progress Energy proceeds with construction and operation of the new units.
