Dear Mr. Riley:

On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your February 28, 2011 letter (Agencywide Documents Access and Management System (ADAMS)

Accession Number ML110620628) requesting that the NRC communicate its decision regarding an exemption from fees under 10 CFR 170.11(a)(1)(iii) prior to the submittal of Nuclear Energy Institute (NEI) MRP-287, Materials Reliability Program: Primary Water Stress Corrosion Cracking (PWSCC) Flaw Evaluation Guidance for review and potential endorsement. Your request does not meet the fee exemption criteria; therefore, I am not granting your request, as explained below.

The NRC makes every effort to efficiently execute the agencys resources that are recovered through fees to its licensees. The NRC does not believe the additional staff effort required to provide a preliminary fee exemption judgment for the review of NEIs draft report MRP-287 is warranted and, thus, not an efficient use of the agencys resources. Furthermore, 10 CFR 170.11(a)(1) requires that the judgment about whether to grant a waiver be made when the document is submitted. Accordingly, I am not granting your request at this time. However, the NRC will consider a fee exemption request from NEI after MRP-287 is formally submitted to the NRC for review.

Please address any future fee exemption requests in writing to the Chief Financial Officer as stated under 10 CFR 170.11(a)(1)(iii). If you have any questions regarding this matter, please contact Rebecca Erickson of my staff at (301) 415-7126.
