Dear Mr. Harrison:
On behalf of the U.S. Nuclear Regulatory Commission (NRC), I am responding to your March 4, 2011, letter requesting an exemption of fees under 10 CFR 170.11 for NRCs review of a proposed exemption and license amendment submittal from South Texas Project Nuclear Operating Company (STPNOC). You have requested consideration of STP Units 1 and 2 as risk informed pilot plants that would address Generic Safety Issue-191 (GSI-191). Your request meets the fee exemption criteria; therefore, I have granted your request, as explained below.
Fee waivers are granted according to the guidelines in 10 CFR 170.11. The NRC staff has reviewed your request and concluded that the review of STPNOCs proposed exemption and license amendment that would address GSI-191 as a risk-informed pilot warrants a fee exemption in the public interest. Hence, I am able to grant you a fee exemption under the provisions of 10 CFR 170.11(b).
Although a fee exemption is granted, it is important to reinforce that the NRC is required by law to recover 90% of its operating expense through user fees. While the effort described in this letter is exempt from direct fee assessment, NRC resources expended to resolve this issue will be included in fees assessed in accordance with 10 CFR 171.
