UNITED STATES OF AMERICA NUCLEAR REGULATORY COMMISSION BEFORE THE ATOMIC SAFETY AND LICENSING BOARD In the Matter of Docket # 50-293-LR Entergy Corporation Pilgrim Nuclear Power Station License Renewal Application April 11 2011 Pilgrim Watch Answer to Entergys and NRC Staffs Reply to Pilgrim Watch Post-Hearing Memorandum Filed April 7, 2011 Entergy and NRC Staff make essentially the same comments in their responses to Pilgrim Watchs Post-hearing Memorandum submitted March 28, 2011; for efficiency, Pilgrim Watch will reply to both in this one filing.
Pilgrim Watch trusts that the ASLB is fully capable of deciding of what facts it will take judicial notice. Those facts quite clearly include that there has been a nuclear disaster in Japan. We are more than a little surprised that both Entergy and the NRC Legal Staff seems to think that this simple fact is still speculative and subject to controversy.
Pilgrim Watch is also surprised by NRC Legal Staffs apparent assertion that The Cause of the Accident in Japan is Speculative, that Pilgrim Watchs statement that the basic cause of the disaster was the loss of off-site power is without any evidence to support that conclusion; and Entergys similar comments. The NRC Information Notice 2011-
05, Tohoku Taiheiyo-Oki Earthquake Effects on Japanese Nuclear Power Plants, dated March 18, 2011 is quite clear (underlining added):
This magnitude 9.0 earthquake and the subsequent tsunami caused significant damage to at least four of the six units of the Fukushima Daiichi nuclear power station as the result of sustained loss of both the offsite and on-site power systems. (Emphasis added)
