As provided in 50 CFR 402.14(d), the NRC staff welcomes Entergys participation in the Endangered Species Act consultation process with the staff and the National Marine Fisheries Service (NMFS). As the owner and operator of Indian Point Nuclear Generating Unit Nos. 2 & 3, Entergy may be able to provide information and access that NMFS may not otherwise have.
The NRC staff received a copy of Mr. Dacimos letter of March 1, 2011, on March 3. Your e-mail - sent yesterday at 5:10p - indicated As we have yet to hear back from the NRC regarding our request for extension, we are assuming it has been granted unless we are otherwise notified today. The NRC staff is aware of no basis for Entergy to assume that an extension has been granted. Further, the timing of Mr. Dacimos letter and your e-mail are such that NRC staff cannot meaningfully respond to your request for extension at this time.
As you know, NRC and NMFS must mutually agree to extend consultation. The NRC staff has already reached out to NMFS staff and expects to speak with NMFS shortly. The NRC staff will promptly respond to Mr. Dacimos letter after conferring with NMFS.
