ASLBP No. 07-858-03-LR-BD01 (Indian Point Nuclear Generating Units 2 and 3) March 8, 2011 ORDER (Deadline to Respond to Entergys Motion to Strike)

On March 4, 2011, Applicant, Entergy Nuclear Operations, Inc. (Entergy), moved to strike as untimely portions of the Combined Reply of Hudson River Sloop Clearwater, Inc. and Riverkeeper, Inc.

(Clearwater/Riverkeeper) to Entergys and the NRC Staffs Answers to new contentions filed by Clearwater/Riverkeeper on January 24, 2011.1 Alternatively, Entergy requests that, if the Board denies the Motion, we establish March 22, 2010, as the final date on which responses to those challenged portions of Clearwaters/Riverkeepers Reply may be submitted.2 Pursuant to NRC regulations, an answer to a motion is due within ten days of the motions filing.3 Accordingly, Clearwater and Riverkeeper have until March 14, 2011, to respond to Entergys Motion to Strike. As soon as practicable after March 14, 2011, the Board will rule on Entergys Motion to Strike.

At this point, prior to the Boards ruling on Entergys Motion to Strike, it is premature to establish a briefing schedule for parties to respond to the substantive matters presented in Clearwaters/Riverkeepers Reply. If we do deny Entergys Motion, we will establish such a briefing schedule.
