Dear Mr. Pietrangelo:
I am responding to your letter of September 3, 2010, in which you enclosed a petition for rulemaking (PRM), on behalf of the Nuclear Energy Institute, asking the U.S. Nuclear Regulatory Commission (NRC) to amend Title 10 of the Code of Federal Regulations (10 CFR) Part 26, Fitness-for-Duty Programs. The petition was docketed as PRM-26-5. The NRC published a notice of receipt and request for public comment on PRM-26-5 in the Federal Register. The comment period closed on January 5, 2011. The NRC received 49 letters with public comments on the petition.
The NRC determined that the issues raised in PRM-26-5 are appropriate for consideration in the planned Quality Control/Quality Verification rulemaking. This rulemaking will also address the requests of two additional PRMs related to the fatigue management provisions of 10 CFR Part 26.
The enclosed Federal Register notice about PRM-26-5 is being transmitted to the Office of the Federal Register for publication. This PRM docket is considered closed upon publication of the Federal Register notice.
