NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY - AMENDMENT NO. 14 TO INDEMNITY AGREEMENT NO. D-9 (TAC NO. ME5128)

Dear Dr. OKelly:

The U.S. Nuclear Regulatory Commission has issued Amendment No. 14 to the Indemnity Agreement D-9 in response to your request by letter dated November 1, 2010. The amendment consists of changes such that additional areas will be covered by the indemnity agreement.

Enclosed with this letter are two signed copies of the amendment. Please sign both copies, retain one for your records and return the other to the following address:

Docket No. 50-184 AMENDMENT TO INDEMINITY AGREEMENT NO. D-9 AMENDMENT NO. 14 Effective January 12, 2011, Indemnity Agreement No. D-9, between the U.S. Department of Commerce Company and the Atomic Energy Commission, dated January 3, 1966, as amended, is hereby further amended as follows:

Item 3 - Location is amended by deleting:

The Reactor Building and the Operations and Assembly Room (No. B-128), the Vault Room (No. B-133), the the [sic] Basement (No. B-2) in Building 235, at the licensee's site near Gaithersburg, Maryland (Amendment 9). The Guide Hall, vestibule, and hallway area connecting the Reactor Building and Guide Hall are included.

and substituting:

The 400 meter radius area centered on the reactor stack for the NBSR located at the licensee's site near Gaithersburg, Maryland.
