January 20, 2011 UNOPPOSED MOTION FOR ORDER ESTABLISHING DEADLINES RELATED TO CONSOLIDATED CONTENTION NYS-35/36.
In accordance with 10 C.F.R. § 2.323(a), Entergy Nuclear Operations, Inc. ("Entergy"),
applicant in the above-captioned proceeding, submits this Unopposed Motion requesting that the Atomic.Safety and Licensing Board ("Board") establish a briefing schedule relative to Consolidated Contention NYS-35/36. Entergy has discussed this matter with the State of New York ("New York") and the staff of the U.S. Nuclear Regulatory Commission
("NRC Staff'), and all parties concur with the schedule outlined below concerning Consolidated Contention NYS-35/36.
On January 14, 2011, New York filed a Motion for Summary Disposition of Consolidated Contention NYS-35/36. The Board's July 1, 2010 Scheduling Order grants other parties 20 days to respond to such a motion, and it also indicates that dispositive motions may be filed up to 30 days after the occurrence or circumstances from which the motion arises. The Board's Scheduling Order, however, does not otherwise specify the time period within which a DOCKETED January 20, 2011 (2:00p.m.)

I cross-motion for summary disposition must be filed. In prior NRC proceedings, the presiding Board has established such deadlines by order.'
Entergy has consulted with New York and the NRC Staff regarding the briefing schedule for Consolidated Contention NYS-35/36, and all parties agree on setting February 3, 2011 as the due date for Entergy and NRC Staff responses and cross-motions for summary disposition. In accordance with the Board's Scheduling Order, New York, NRC Staff, and Entergy would then have until February 23, 2011 to file any responses to cross-motions for summary disposition filed by any other party.
Good cause exists for this Unopposed Motion because these proposed deadlines will allow Entergy and the NRC Staff to each consolidate their respective responses and cross-motions, which would avoid duplicative pleadings on the same topics. Additionally, the parties believe that this schedule will, in a timely and efficient manner, present the Board with information necessary to potentially resolve all or part of Consolidated Contention NYS-35/36 witho~ut the need for a hearing. Accordingly, Entergy requests that the Board establish February 3, 2011 as the deadline for responses and cross-motions for summary disposition on NYS-35/36, and February 23, 2011 as the deadline for responses to cross-motions for summary disposition on NYS-35/36.
