ORDER (Extending Deadline for Certain Mandatory Disclosures)
In our Initial Scheduling Order (ISO) the Board established deadlines for the parties and the NRC Staff to make mandatory disclosures pursuant to 10 C.F.R. § 2.336 and for the NRC Staff to produce the hearing file pursuant to 10 C.F.R. § 2.1203(a). ISO (Sept. 15, 2010) at 4-5 (unpublished). For contention EC-4 the deadline was the earlier of (a) March 15, 2011, or (b) thirty (30) days after the Commission rules on the referral of the contention. ISO at 4. For contention TC-1 the deadline was the earlier of (a) March 15, 2011, or (b) thirty (30) days after the Commission rules on the interlocutory appeal of the contention. ISO at 5.
Subsequently, the NRC Staff informed the Board that the Staffs review of the application has been delayed. Specifically, the Staffs environmental review has been delayed by four months. See NRC Staff Status Update (Oct. 15, 2010) (projecting a delay in issuing the draft Supplemental Environmental Impact Statement from October 15, 2010 to February 18, 2011).
Likewise, the Staffs safety analysis was delayed by one month. See NRC Staff Status Update (Dec. 14, 2010) (projecting a delay in issuing the Safety Evaluation Report with open items from December 10, 2010 to January 10, 2011).
In light of these delays, the new deadline for making these mandatory disclosures and providing the hearing file for EC-4 and TC-1, respectively, is the earlier of (a) May 16, 2011, or (b) thirty days after the Commission ruling on the contention.
