Page 1 REGULATORY ANALYSIS DRAFT REGULATORY GUIDE (DG) - 5019 REPORTING AND RECORDING SAFEGUARDS EVENTS (Proposed Revision 2 of Regulatory Guide 5.62, dated November 1987)

The regulatory analysis prepared for the revised proposed amendments of Title 10 of the Code of Federal Regulations (10 CFR) 73.71, Reporting and Recording of Safeguards Events and Appendix G, Reportable and Recordable Safeguards Events provides the regulatory basis for this guide and examines the costs and benefits associated with implementing the rule as described in this guide. This regulatory analysis has been incorporated into the Federal Register notice for the revised proposed rule.1 A separate regulatory analysis was prepared for the original proposed amendments to 10 CFR 73.71 and Appendix G, as specified in the October 26, 2006, Federal Register notice.2 An electronic copy of the revised proposed rule (and the incorporated regulatory analysis) is available for free review and downloading at the Federal e-Rulemaking Web portal at http://www.regulations.gov by searching for documents filed under Docket ID NRC-2008-0465.

This draft guide provides applicants, licensees or certificate holders with new guidance that the NRC staff considers acceptable for reporting and recording safeguards events, as set forth in proposed amendments to 10 CFR 73.71 and Appendix G.

This draft guide discusses provisions that relate to information collection, reporting, and recording requirements. The agency does not interpret the back-fit rules in 10 CFR Chapter 1 as applicable to information collection, reporting, and recording requirements. However, the burden to be imposed on licensees and certificate holders should be justified in view of the potential safety and/or security significance of the information requested by the agency.
