RESPONSE TO NOTICE OF VIOLATION 70-1151/2009-005-01

Dear Mr. Precht:

This refers to your October 18, 2010, response to the Notice of Violation transmitted to you by our letter and NRC Inspection Report No. 70-1151/2009-005, dated October 15, 2010. We have reviewed your response and determined that you have, to the extent possible, adequately addressed the cause of the violation and established adequate corrective actions to prevent recurrence. The violation will remain open until we have verified implementation of your corrective actions during a future inspection.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
