Combined License Application for Levy County Units 1 & 2 Dockets Numbers 52-029-COL and 52-030-COL December 24, 2010 Note to All First: Seasons Greetings and Happy New Year!
Second: Interveners wish to record that due to lead Interveners preoccupation with family illness, only this morning was the error in our reading of the time allowed to Answer an Appeal under 10 CFR 2.341 apprehended. We regret that we missed our opportunity to brief the Commission on the status of Contention 8A.
Third, we merely wish to offer this note:
The careful reasoning of LBP-10-20 and its conclusion were not read by the Interveners as a ruling on the merits our contention - rather a statement that disposition would NOT be summary as requested by the Applicant; further engagement with the matter is warranted.
Progress Energy Florida was invited to further amend its FSAR, or alternately to engage in a full hearing on potentially material facts we raised in Answering its Motion for Summary Disposition.
Little has been offered by Applicant or Staff here that is relevant to this status.
If the Commission now decides to rule on the merits of our contention, we stand by our defense of it and the potentially material facts we have raised which are already in the record.
