Dear Ms. Sutley:
Enclosed please find the U.S. Nuclear Regulatory Commissions (NRCs) Cooperating Agency Report regarding all Environmental Impact Statements (EISs) with a published Notice of Intent (NOI) during Fiscal Year 2010 and Environmental Assessments (EAs) completed during Fiscal Year 2010.
As stated during previous interactions and correspondence with Council on Environmental Quality representatives, the NRC does not routinely use cooperating agency agreements.
However, NRC has two EISs in progress that involve cooperating agencies. One EIS involves the U.S. Army Corps of Engineers participation for the proposed Turkey Point, Florida, new reactor project (Units 6 and 7). The NRC is requesting the National Park Service (Everglades National Park unit) to also participate as a cooperating agency in this EIS. The other EIS involves uranium recovery licensing actions with the Bureau of Land Management for the Dewey-Burdock, Wyoming, In-Situ Recovery license application.
Although NRC does not normally enter into formal cooperating agency agreements in the vast majority of NRC licensing actions, we routinely and extensively consult with other Federal, State, Tribal and local entities during development of EISs and EAs. We believe that these efforts to seek other agencies' input achieve the spirit of more formal Cooperating Agency relationships.
