Dear Dr. Bacchus:
This letter responds to your letter dated November 27, 2010 (ML103340103), in which you requested an additional 30-day extension to complete your comments on the Levy Nuclear Plant (LNP) Draft Environmental Impact Statement (DEIS).
As mentioned during the teleconference held with you and the U.S. Nuclear Regulatory Commission (NRC) staff on November 3, 2010, as well as the letter sent to you on November 10, 2010 (ML103080027), per NRC regulation under Title 10 of the Code of Federal Regulations, Section 51.73, a minimum comment period of 45-days is provided for commenting on a DEIS. However, in the interest of improving opportunities for public involvement, the staff typically provides a 75-day comment period for new reactor DEIS reviews. Based on the information that you provided regarding your visual impairment during the teleconference held on November 3, 2010, as well as your letter dated on October 26, 2010 (ML103050063), the staff agreed to provide an additional 30 days, for a total of 105 days for you to provide comments on the DEIS. The NRC staff received your comments on November 27, 2010, and believes that the time provided was sufficient for you to comment on the LNP DEIS. Therefore, your request for an additional 30 days to comment on the Levy DEIS is denied.
