Dear Mr. Marion,
Thank you for the letter dated November 15, 2010 (ADAMS Accession No. ML1033604060),
expressing your concerns and recommendations with respect to our planned review of license amendment requests (LARs) from licensees transitioning to Title 10 of the Code of Federal Regulations (10 CFR) Part 50.48(c), and informing us of potential challenges confronting the licensees in this arena.
We recognize that the extended schedule for completion of the pilot plant reviews has resulted in the expectation of submission of a large number of applications within six months after completion of the second pilot review consistent with the current Nuclear Regulatory Commission (NRC) enforcement discretion for those facilities transitioning to 10 CFR 50.48(c).
Staggering the submission of applications as suggested in your letter, is one option to effectively deal with this workload. We will evaluate your proposal carefully within the context of the NRCs enforcement discretion policies.
