December 10, 2010 Mr. Scott P. Murray, Manager Licensing and Liabilities COE Global Nuclear Fuel - Americas P.O. Box 780 Wilmington, NC 28402

SUBJECT:

GENERAL ELECTRIC COMPANY PARENT GUARANTEE OF FUNDS FOR DECOMMISSIONING, ANNUAL FINANCIAL TEST (TAC L32991)

Dear Mr. Murray:

The U.S. Nuclear Regulatory Commission (NRC) reviewed your documents relating to financial assurance for the General Electric Company, submitted by letters dated March 18 and May 28, 2010. This financial assurance documentation addresses decommissioning financial assurance for the Global Nuclear Fuel - Americass Fuel Manufacturing facility, the Reuter-Stokes facility, the Vallecitos Nuclear Center, and the Morris Operations facility.

The NRC staff reviewed the documents for conformance to NRCs regulations and NUREG-1757, Volume 3, Consolidated NMSS Decommissioning Guidance: Financial Assurance, Recordkeeping, and Timeliness. The documents submitted were found acceptable in accordance with NUREG-1757, Volume 3, Appendix A.14. The licensees comply with Appendix A, Criteria Relating to Use of Financial Tests and Parent-Company Guarantees for Providing Reasonable Assurance of Funds for Decommissioning of Title 10 of the Code of Federal Regulations (10 CFR), Part 30; therefore, the parent company guarantee is acceptable financial assurance for decommissioning. To continue utilizing the parent-company guarantee, General Electric must repeat passage of the financial test within 90 days after the close of each succeeding fiscal year as required by 10 CFR, Part 30, Appendix A, Section C.1.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs document system, Agencywide Documents Access and Management System (ADAMS). ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
