RE: Final Report - Guided Wave Technology Importance: High Tim, I talked this over with our legal representatives when I read the statement at the bottom of the first page of the report. This is what I understand based on discussions with our legal representative:

PSEG Nuclear is under an obligation to protect proprietary information that is owned by our vendors. If we were to submit information to the NRC without taking further precautions to protect the information from disclosure, such information would become a government record and be subject to public disclosure under FOIA and NRC policy. By allowing the NRC inspector to view the material on-site, the NRC would never have possession, custody, or control of the document and would not be vulnerable to public disclosure. In the alternative, we could submit the information to you using the labeling and affidavit requirements described in 10 CFR 2.390. This process, however, would take time and require involvement of IMPro Technologies, legal and senior management.

I thought it would be more convenient if we just let you view the material on-site.
