Request for revision of the self-guarantee for decommissioning funding assurance
Dear Ms. Proskine,
As discussed during our telephone conversation on October 7, 2010, the information dated August 31, 2010, regarding decommissioning funding assurance for the Rensselaer Polytechnic Institute (RPI) Critical Experiments Facility (RCF) requires revision. Please address the following issues and submit a revised copy of the self-guarantee agreement and Chief Financial Officers (CFO) letter.
- 1. There are numerous references in the CFOs letter and the self-guarantee agreement to Title 10, Chapter I of the Code of Federal Regulations (10 CFR), Part 30. The regulations in 10 CFR Part 30 apply only to domestic licensing of byproduct materials (although the appendices contain financial tests for decommissioning funding that are incorporated by reference into regulations for other types of NRC licenses). With the exception of the second reference in Recital 4 of the self-guarantee agreement, revise the references to reflect that the RCF is licensed under 10 CFR Part 50.
- 2. Provide numbering for all Recitals in the self-guarantee agreement.
- 3. Revise Recital 2 of the self-guarantee agreement to reflect that RPI has a facility license for the RCF, and not a materials license.
- 4. Recitals 6 and 14 of the self-guarantee agreement refer to facilities, whereas the CFOs letter only lists one facility (i.e., the RCF). Revise the Recitals to be consistent with the CFOs letter.
- 5. Consider deleting Recital 10 of the self-guarantee as it is redundant with the regulations for transfer of a facility license.
