CONFIRMATORY ACTION LETTER

Dear Mr. Geuther:

On September 24, 2010, the Kansas State University Research Reactor reported an event to the U. S. Nuclear Regulatory Commission (NRC) where circumstances surrounding the removal of an experiment from the reactor pool caused higher than expected dosimeter readings for personnel in the area, and unexpected changes in the restricted area dose rate in excess of 20 rem per hour. Based upon your reporting of the event, the NRC chartered a Special Inspection Team to independently assess your investigation of the causes of the event. Subsequently, on October 1, 2010, you submitted a 10-day report describing the causes of the event and the corrective actions which you deemed necessary to minimize the possibility of a similar occurrence. Following the review of your report, in a teleconference on October 6, 2010, NRC staff identified needed clarifications to your corrective actions, and on October 7, 2010, you submitted a supplement to your 10 day report.

Pursuant to your 10-day report which you later supplemented on October 7, 2010, it is our understanding that the corrective actions detailed in the report will be completed prior to restarting the reactor, except for the actions discussed in item 5, concerning the Reactor Safeguards Committee, which will be completed at your earliest opportunity. Following completion of all the corrective actions, you are required to provide the NRC with written confirmation of completed actions.

As we informed you in a telephone conversation on October 7, 2010, based on your corrective actions, the NRC has no objection to you restarting the Kansas State Reactor. The NRC will verify that you have completed the corrective actions in a subsequent inspection the week of October 11, 2010.

Pursuant to Section 182 of the Atomic Energy Act, 42 U.S.C. 2232, you are required to provide written notification to the NRC immediately if your understanding differs from that set forth above. You are also required to provide written notification to the NRC if you intend to change, deviate, or not complete any of the documented commitments, prior to the change or deviation.

Issuance of this Confirmatory Action Letter does not preclude issuance of an order formalizing the above commitments or requiring other actions on the part of the licensee; nor does it preclude the NRC from taking enforcement action for violations of NRC requirements that may

J. Geuther have prompted the issuance of this letter. In addition, failure to take the actions addressed in this Confirmatory Action Letter may result in enforcement action.
