Dear Mr. Saporito:

Your letter dated September 12, 2010, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission (NRC), was referred to the Office of Nuclear Reactor Regulation pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Section 2.206 of the Commission's regulations. In your letter, you request:

1. The NRC take enforcement action against the above-captioned licensee [Florida Power & Light Company (FPL)] and suspend, or revoke the NRC Iicense(s) granted to the licensee for operation of the Turkey Point Nuclear Plant, Units 3 and 4; and
2. Issue a notice of violation with a proposed civil penalty against the collectively named and each singularly named licensee captioned-above.

As the basis for your request, you refer to legal proceedings involving a complaint you filed with the United States Department of Labor regarding your termination of employment by FPL in December 1988, and that the NRC staff failed to consider significant new evidence in its prior decisions.

Our petition review board reviewed your submittal in accordance with Management Directive 8.11, "Review Process for 10 CFR 2.206 Petitions." The NRC staff has concluded that your submittal does not meet the criteria for consideration under 10 CFR 2.206 because it did not present substantial new information for issues that have already been the subject of NRC review and evaluation.

Accordingly, as Chairman Jaczko stated to you in his September 23, 2009, letter, no further action needs to be taken by the NRC on this issue. If you have additional questions, please feel free to contact Mr. Jason Paige at (301) 415-5888.
