Peryourrequest,pleasefindattachedinformationrelatedtoIndianPointthermaldischargelimitations.

Briefly,theinformationshowsthat:

IndianPointhasacurrentSPDESpermitincludingthermaldischargelimitations,whichNSYDEC officially(andnecessarily,asamatterofNewYorklaw)concludedcomplywithNewYorkWater QualityStandards("NYWQS").

NYSDEChasneverconcludedthatIndianPointisinnoncompliancewiththermalNYWQS,butit hassoughtmorerecentstudiestoconfirmasmuch,asithaswithmost(ifnotall)othermajor thermaldischargerslocatedthroughoutNewYorkState.

Morespecifically,thefollowingdocumentswithsummaryexplanationsareprovided:

(1)Acopyofthecurrent,validSPDESpermit(issuedin1987),withallmodifications,includingwhatI understandisthemostrecentmodification(asofFebruary20,2004).Thispermitconfirmsthat thesolemaximumdischargetemperaturefortheStationis110degreesF,measuredatDSN001.

SeePermit,p.2of19(ConditionNo.1).Italsorecordsintwoplacesthatthedischarge criteriaareincompliancewithapplicableNewYorklaw,whichincludesthermalwaterquality standardsfoundat7NYCRRPart704.

Specifically,thefirstsentenceofthepermitstates:

"ThisSPDESpermitisissuedincompliancewithTitle8ofArticle17oftheEnvironmental ConservationLawofNewYorkStateandincompliancewiththeCleanWaterAct,"whichare theenablinglawsfortheNewYorkthermallimits.SeePermit,p.1of19.

In2004,NYSDECamendedthepermittoincludenewGeneralConditions,whichincludedthe following:"UponissuanceofaSPDESpermit,adeterminationhasbeenmadeonthebasisofa submittedapplication,plans,orotheravailableinformation,thatcompliancewiththespecified permitprovisionswillreasonablyprotectclassifiedwaterusesandassurecompliancewith applicablewaterqualitystandards."ThislanguagereflectstheexpresslanguageoftheNYSDEC regulationat6NYCRR7502.1(b).Itisaverystrongstatementanddirectlyconfirmsthat NYSDEC'spermitdemonstratescompliancewithNYWQS.

2 (2)AcopyeachoftheNYSDECstaff'sselfstyled"tentative"2003draftpermit,andtherevised2004 draftpermit(labeledreviseddraft),whichreflectstheresolutionbetweenEntergyandNYSDEC Staffonthermaldischarges,amongotherfactors.

Notably,thedraftpermitdoesnotproposetochangeanyofthethermallimitsintheexisting,valid permit.Rather,itaddsonlyarequirementforthepreparationofathreedimensionalthermal study,tobeperformedafterthedraftpermitismadefinallyeffective.Seedraftpermit,p.10of25, section7(b).Thereisnosuggestionwhatsoeverinthisparagraphorinthedraftpermitofnon compliancewiththermalcriteria,andNYSDEChasbeenclearinstating(asreflectedintheir permits)thatallmajorfacilitiesarebeingrequiredtoperformcurrentthreedimensionalthermal analyses.

Alsoincludedistheaccompanyingfactsheetforthedraftpermit,whichindicatesthatthereisa potentialforexceedancesofthermalcriteria,butreachesnosuchconclusion.

(3)Correspondenceregardingthe2005resolutionofthermalissuesbetweenEntergyandNYSDECin theSPDESpermitproceeding(beforetheALJs).Specifically,thisincludesaletterfromEntergy andNYSDEC,datedJune12,2009,whichincludesNSYDEC'ssummaryletter,datedSeptember22, 2005,totheALJsregardingtheconsensusagreementofEntergyandNYSDECstaff.This correspondenceensuredthatthermalissueswouldnotbelitigatedinthependingSPDES administrativeproceeding,whichreflectsNYSDEC'spositionthatdelayedthermalanalysis representednocredibleenvironmentalconcern.IalsoincludedtheJuly3,2009letterwhich summarizesthebackandforthhere.
