Notes from River Bend Station Telcon on Decommissioning Funds On September 16, 2010, the NRC staff had a call with Entergy regarding choice letter for the River Bend Station regarding its decommissioning fund. The following summary was provided by Anneliese Simmons of the Financial, Policy, and Rulemaking Branch:
Tim McGinty, Director, DPR, informed Entergy that they would be receiving a choice letter from the NRC regarding apparent decommissioning funding violations for River Bend. He indicated that the letter would be made publicly available. McGinty recited the three apparent violations listed in the letter. He also stated that Entergy would have 10 days to decide if they would reply in writing to the letter or request a pre-enforcement conference and that any conference would include the public. He also indicated that no NOVs would be issued at this time, and that no final decision regarding NOVs would be made by the agency until after a pre-enforcement conference or written response from Entergy. Entergy officials asked McGinty to repeat the three violations for clarification, which he did. Entergy officials also requested the reasons why the staff did not feel the contract was sufficient. Tom Fredrichs responded by reciting the two reasons provided in the factual summary of the choice letter. Entergy officials also asked if alternative dispute resolution was an option. Greg Bowman answered that ADR was not an option unless the potential violations were willful or involved discrimination, which Bowman stated was not the case here.
