Dear Supervisor Wolf:

On behalf of the U.S. Nuclear Regulatory Commission (NRC or the staff), I am responding to the Santa Barbara County Board of Supervisors (Board) letter dated August 4, 2010. In the letter, the Board requested that the NRC wait until the completion of the proposed three dimensional (3-D) geophysical mapping of the Shoreline Fault before relicensing Diablo Canyon Power Plant, Units 1 and 2 (DCPP). Currently, the staff is reviewing Pacific Gas & Electric Co.s (PG&Es) application to renew the operating licenses for DCPP. The NRC has not yet made a decision on the application and will not do so until safety and environmental reviews are complete and any outstanding adjudicatory hearing items have been resolved.

Delaying the license renewal review does not enhance the staffs ability to address seismic issues at DCPP. The NRC addresses seismic safety issues, including those related to the Shoreline Fault, through its ongoing oversight process. It is important to note that the license renewal review does not affect the ongoing safety oversight process. The NRC staff is involved on a daily basis in monitoring and inspecting the operations at DCPP. By addressing seismic issues within the agencys continuing safety oversight of the power plant, the NRC staff can quickly respond to new information, as the agency demonstrated when it monitored PG&Es response to the discovery of the Shoreline Fault, and then conducted preliminary assessments to determine whether the new fault threatens safe plant operation.

Should information, including the results of ongoing 3-D mapping, show that there is a basis to question the continued safe operation of DCPP, then the NRC will take the appropriate actions as part of the agencys ongoing safety oversight. The NRC staff will continue to monitor assessments of the Shoreline Fault and other seismic issues around DCPP and will ensure that the power plants safety systems remain capable of safely shutting the plant down in case of a seismic event.
