RE: Follow up NRC Diablo License Renewal Process meeting Feb 9th and FINANCE QUESTIONS Mr. Weisman -

I've followed several different paths in pursuit of the financial information you seek. In each case, however, the answer I ultimately received is that you will need to file a Freedom of Information Act (FOIA) request in order to obtain the information. You may already be familiar with the NRC's FOIA process, but if not, please visit http://www.nrc.gov/reading-rm/foia/foia-request.html. This webpage provides instructions on how to file a FOIA request, as well as the types of information you should include in the FOIA request. The process also includes provisions for expedited processing.

Based on my discussions with various levels of NRC staff, I will also point out that your initial request should include an indication of willingness to pay applicable fees (more information is available on the webpage listed in the previous paragraph). I mention it here because I understand that some requesters have seen FOIA requests delayed because they didn't address fee payment in their requests. There is also a fee waiver process - again, addressed on the FOIA webpage - that may apply to your request.

Please let me know if you have any questions about the FOIA process.

Best regards, Drew Drew Stuyvenberg U.S. Nuclear Regulatory Commission 301-415-4006 Andrew.Stuyvenberg@nrc.gov

Re: Follow up NRC Diablo License Renewal Process meeting Feb 9th and FINANCE QUESTIONS Hello Drew,

...and while we are on the subject of questions asked (and not answered) I was wondering about this one...our request that we be shown where and how to access the current financial cost of the ongoing relicensing procedure, as recorded by the NRC in the "account" set up particularly for Diablo Canyon.

This would include all the costs the NRC "bills" towards the Diablo relicensing process, from labor and overhead to travel and yes, even the plethora of police and security at our local meeting.

2 I must emphasize that this is a question that cannot await an answer in the broader context, as you indicated to Rochelle, to be published eventually as part of the "environmental scoping comments." We are now entering, at the state level, the CPUC proceedings for the financing of this license renewal and we certainly need to compare whether your numbers and the numbers PG&E is putting forth will match. Our pre-hearing conference for this CPUC process begins on April 14. Our initial request for this information goes back to the meeting held in SLO in February, thus our desire to see these answers expedited now in a timely fashion.

Thanks for your attention to this matter.
