RAI's related to Part 26 exemption Ken and Eric, Below is a Draft set of Requests for Addition Information related to your October 16, 2009, exemption request. I am sending an advance copy and will send it also formally within the next few days. This draft will allow you to begin reading to ensure the question are clear enough to begin preparing a response:

REQUEST FOR ADDITIONAL INFORMATION ST. LUCIE UNITS 1 AND 2 PROPOSED EXEMPTION REQUEST DOCKET NUMBERS 50-335 and 50-389 By letter dated October 16, 2009, Florida Power & Light Company, the licensee for St Lucie Station Units 1 and 2 requested an exemption from the 10 CFR 26.205(c) and (d) work hour control requirements when defined conditions (tropical storm force winds and other conditions) are present prior to and after the declaration of a plant emergency. The request would have the effect of extending the applicability of the existing exemption from declared plant emergencies, 10 CFR 26.207(d).

The purpose of the request is to allow St. Lucie to sequester an appropriate number of plant personnel designated as the "storm crew" prior to the onset of hurricane force winds.

The Health Physics and Human Performance Branch performed a preliminary review of the exemption request. The licensees responses to the following request for additional information will allow the staff to complete its review in a timely manner.

What general criteria will the Hurricane Response Coordinator look at to make the determination that there are enough people onsite to resume work hour controls?

Describe the St. Lucie methodology that will be used to ensure that individuals are not fatigued on the first day back to work, following the exemption period.

The exemption request discusses the St. Lucie storm crew. Clarify whether the exemption is strictly for the storm crew and not for discretionary maintenance or the direction of discretionary maintenance that a risk informed evaluation has shown to be a significant to public health and safety.

A March 11, 2010, letter in response to staff RAIs indicated that:

Plant procedure AP-0005753, Severe Weather Preparations provides instructions to be followed to prepare for severe weather Site staffing procedure AP-0006128 identifies personnel who are to remain onsite during a hurricane to oversee hurricane preparations and response activities

Plant procedure AP-0005753 give the plant general manager discretion to perform hurricane preparation activities for projected weather conditions less severe than hurricanes (e.g. tropical storms)

Provide a copy of these procedures and any other procedures related to severe wind site preparation or recovery, or other declared plant emergencies.

This draft email will be added to the docket and place in ADAMS.
