SUBJECT: RESPONSE TO RIVER BEND STATION REPLY TO NOTICE OF VIOLATION

EA-10-095 IN NRC TRIENNIAL FIRE PROTECTION INSPECTION REPORT

05000458/2010006

Dear Mr. Perito:

This acknowledges receipt of your letter and attachments (RBG-47046) dated, July 19, 2010, in

which you responded to a notice of violation NOV 05000458/2010006-01, "Failure to Ensure at

Least One Train of Equipment Necessary to Achieve Hot Shutdown Conditions is Free of Fire

Damage."

The notice of violation requested that your response include information about decisions to

extend the completion of necessary plant modifications beyond the October 2009 refueling

outage. The decision-making process described in the letter was consistent with our

understanding from the inspection. However, your response did not specifically address your

assessment of the appropriateness of the decisions to extend the completion of necessary plant

modifications beyond the October 2009 refueling outage. This information is required to

determine whether the corrective actions for this violation were appropriate.

In a telephone conversation on August 13, 2010, with Roy Caniano, Director, Division of

Reactor Safety, you agreed to submit a supplemental response to the Notice of Violation to

address your assessment of the appropriateness of the decisions to extend the schedule for

completing the plant modification and to provide additional information concerning the

engineering quality problems and parts availability that caused the delays in completing timely

corrective actions.

The response letter stated that although you agreed with the finding related to the fire protection

requirements for a main control room fire, you requested that the NRC reconsider the issuance

of the notice of violation and that the portion of the notice of violation involving timeliness of

corrective actions be re-characterized. We have reviewed the information provided in your letter

and noted that no new information was provided beyond what was reviewed as part of the

inspection. After reviewing your letter and our finding, the NRC has concluded that the violation

was appropriate.
