STATE OF VERMONT HOUSE OF REPRESENTATIVES 115 STATE STREET MONTPELIER, VT 05633-5201 Chairman Gregory Jaczko U.S. Nuclear Regulatory Commission Mail Stop O-16G4 Washington, DC 20555-0001 Representative Sarah Edwards House Natural Resources and Energy 127 Main Street, 4A Brattleboro, VT 05301 August 2, 2010
Dear Chairman Jaczko:
First, I would like to extend my appreciation for making the trip to Brattleboro on July 14 to meet with the various groups who have serious concerns about the continued operation of Vermont Yankee. As a member of the audience, it became clear that many of the concerns centered around the next 20 months, the time between now and the scheduled closure of the station in March 2012. The groups want to work with the NRC to assure that the final twenty months of Vermont Yankee's operation are safe (NRC's purview), and that preparations are sufficient to allow current employees to transition to work for the decommissioning of the site, including greenfield status, an agreement made by Entergy with the State of Vermont.
Since your visit, I have been contacted by some of the participants asking if I have received any word or response from you regarding specific requests that were made during the meeting.
To recap, for your convenience I am listing four requests that were presented at the meeting:
o The NRC should cease consideration of ENVY's relicensing application promptly, and turn all regulatory focus toward ensuring safety during the transition to closure of the Vernon reactor, and implementation of comprehensive waste storage procedures. NRC should act with transparency to enforce its regulations and maintain strict vigilance so as to ensure against accidents, mishaps, and accidental releases in the interim.
o The NRC should compile and disseminate a detailed plan for closure of Chairman Gregory laczko STATE OF VERMONT HOUSE OF REPRESENTATIVES 115 STATE STREET MONTPELIER, VT 05633-5201 U.S. Nuclear Regulatory Commission Mail Stop 0-16G4 Washington, DC 20555-0001 Representative Sarah Edwards House Natural Resources and Energy 127 Main Street, 4A Brattleboro, VT 05301 August 2, 2010

o The NRC should compile and disseminate a detailed plan for closure of
08.02.10 - page 2 Vermont Yankee. This plan should include a list of tasks and a timeline for their completion, in anticipation of closure in 2012. This plan should reflect NRC staff expertise, lessons learned from other reactors, and the particular expertise ofpeople who have worked at Vermont Yankee or who have relevant knowledge of its operations.
o The NRC should work with the licensee, state and local government officials, Entergy workers, independent experts and affected citizenry to form an advisory panel to advise and monitor activities directed toward a safe transition to closure.
o The NRC should prepare and distribute monthly reports to update the public and elected officials about the closure process.
I have received feedback that the groups very much appreciated the open dialogue, and they would like to establish a more formal timeline for when you might respond to their points.
They would appreciate hearing from you.
If you wish, I can furnish you with the contact information for each group, or I would be happy to serve as the repository for any communication from your office.
-Again, thankyou for taking the time out of your rigorous schedule to engage the various groups. I look forward to hearing from you.
Best regards, Representative Sarah Edwards 08.02.10
